The Hon Judge of Patna High Court heavily came down on police for arresting a lady doctor. It is an established norm as per orders of Hon Supreme court that no doctor should be arrested without preliminary investingation and such an investigation should also include the opinion of experts of medical field. The Jacob Mathew versus state of punjab case as well as Lalita Kumari Vs Government of Uttar Pradesh lays down such guidelines.

In the Instant case the police arrested lady doctor under section 304 of IPC without undertaking preliminary enquiry as mandated in the cases of The Jacob Mathew versus state of punjab case as well as Lalita Kumari Vs Government of Uttar Pradesh. 

When the advocate for the petitioner brought these facts to attention of Hon Justice the judge became furious and said

 क्या जल्दबाज़ी हो गयी थी इन को अररेस्ट करने की आपको ? डॉक्टर … लेडी डॉक्टर थी … कोई serious allegation नही था इनके उपर ….. क्या जरुरत थी उनको हथकडी लगा कर गाडी मे  बैठाने की ….आप भले आदमी है ना …  अगर यही  काम आपके साथ किया जाए … कोई गल्ती हो जाये आपसे … या गल्ती ना भी हो कोई आपके उपर allegations लगादे … और आपको इसी तरह घर से उठा करके गाडी मी बिठाकर आपके जैसे वर्दी वाले लोग घेरे रहेंगे तो आपको कैसा लगेगा … बताईये ?
